Resumen
El Atlántico Sur (AS) es escenario del conflicto que el Estado argentino, en su
condición de país ribereño, mantiene con los Estados de pesca oceánica respecto a la interpretación dispar del régimen internacional vigente, la Convención del
Mar de las Naciones Unidas - CONVEMAR – en la explotación sustentable de
los recursos pesqueros.
Además, es un escenario condicionado por la disputa de soberanía entre la República Argentina y el gobierno del Reino Unido de Gran Bretaña por las Islas
Malvinas. En él, subsiste un conflicto cuyos alcances y propósitos mutaron en
relación a los intereses en juego y que ha generado diversas situaciones confrontativas consecuencia de complejas conexiones transnacionales entre los Estados y las sociedades que los conforman.
El régimen internacional que norma el desarrollo sustentable de los recursos vivos renovables es vulnerado por naciones de terceras banderas consecuencia
del incumplimiento de las normativas vigentes. Esa deficiencia surge de un déficit de articulación entre la política doméstica y el sistema internacional, agravada
por el incumplimiento del Estado argentino de algunas normas prescriptas legalmente que derivan de la mencionada Convención y que condicionan la pr esencia estatal en el escenario AS.
El interés de esta investigación es analizar en qué medida el incumplimiento de
las normativas nacionales vigentes, que se derivan de CONVEMAR, afecta la
capacidad del Estado argentino para generar las medidas necesarias de protección y conservación de los recursos vivos en el escenario AS, así como examinar en qué medida esas políticas contribuyen a desarrollar un ámbito de cooperación entre los actores que mantienen intereses en el escenario.
The South Atlantic is the stage of the conflict that the Argentine State, as a coastal country, keeps with the States of ocean fisheries with respect to the different interpretation of the current international regime, the United Nations Convention Law of the Sea - UNCLOS - on the sustainable exploitation of fisheries resources. It is, a scenario conditioned by the sovereignty dispute between the Republic Argentina and the government of the United Kingdom of Great Britain about the Falkland Islands. There is still a conflict whose scope and purposes mutated in relation to the interests that are involved and that have generated various confrontational situations resulting from complex transnational connections between states and the societies that make them up. The international regime that regulates the sustainable development of the renewable living resources is violated by other nations as a result of the breach of current regulations. This deficiency arises from a deficit of articulation between the domestic policy and the international system, aggravated by the infraction of the Argentine State of some norms prescribed legally that derive from the above mentioned Convention and that conditions the state presence in the South Atlantic scenario. The aim of this investigation is to analyze to what extent the failure of existing national regulations deriving from the UNCLOS, affects the ability of the Argentine government to generate the necessary measures for the pr otection and conservation of living resources in the South Atlantic scenario and examine how these policies contribute to developing a framework for cooperation among actors with interests in the stage.
