Resumen
La presente tesina se propone generar un aporte al estudio sobre los Derechos
Humanos de los pueblos indígenas, dentro del campo de las Relaciones Internacionales.
Teniendo como marco teórico al pensamiento decolonial, se analizó el conflicto desatado en la
zona de las Salinas Grandes y la Laguna de Guayatayoc durante el periodo 2010-2016. El
conflicto se originó por la denuncia de 33 comunidades ante proyectos inconsultos de
exploración de litio sobre sus territorios, que amenazan sus tierras, su subsistencia y el ejercicio
de derechos. De este modo, se analizó, la efectividad de la aplicación de los derechos al
territorio, a la consulta previa y al consentimiento libre, previo e informado. Este trabajo tiene
como hipótesis la existencia de una brecha entre el reconocimiento jurídico de esos derechos y
su aplicación en este territorio. Mediante esta tesina se busca visibilizar la problemática y las
demandas de estas comunidades, a fin de colaborar y generar un aporte a su causa aun latente.
My thesis proposes making a contribution to the studies of indigenous populations’ Human Rights, within the field of International Relationships. Having the decolonial thinking as a theoretical framework, I analyzed the conflict unleashed in the area of Salinas Grandes and Laguna de Guayatayoc, during the period 2010-2016. That conflict was originated by the complaint of 33 communities against non-query projects of litio exploitation made on their territories, which threated their lands, their substance, and their exercise of rights. Thus, I analyzed the efficiency of application of the following rights: territory, previous query, and free, prior and informed consent. My hypothesis is that there is a gap between legal recognition of those rights, and their implementation on this territory. With this thesis I seek for visualizing these communities’ troubles, and demands, in order to cooperate, and contribute to their still latent cause.
