El presente artículo se aboca al rol de la municipalidad de San Salvador de Jujuy en torno a la reglamentación y distribución del agua para riego. La aparición de ese nivel de gobierno data del año 1856, y su puesta en funcionamiento y normalización incluyó, entre otras cuestiones, los elementos normativos que aquí consideramos. Trabajos anteriores han analizado ese contexto y la problemática derivada entre los poderes provincial y municipal para legislar el recurso hídrico, en este artículo pretendemos abordar las décadas de 1860 hasta 1890, que de alguna manera estuvieron signadas por un mayor desenvolvimiento institucional aunque, como se buscará demostrar, no implicó que la municipalidad adquiriera las facultades subjetivas de mando en términos weberianos, para poder disponer de los cánones de riego y los funcionarios destinados a vigilar el reparto del agua.
This article focuses on the role of the municipality of San Salvador de Jujuy in the regulation and distribution of water for irrigation. The appearance of that level of government dates from 1856, and its implementation and standardization included, among other issues, the normative elements that we consider here. Previous work has analyzed this context and the problem derived between the provincial and municipal powers to legislate the water resource, in this article we intend to address the decades of 1860 to 1890, which were somehow marked by a greater institutional development although, as will be sought To demonstrate, it did not imply that the municipality acquired the subjective powers of command in Weberian terms, in order to have the irrigation fees and the officials destined to monitor the distribution of water.
