El autor propone conectar preocupaciones jurídicas, políticas e historiográficas sobre la problemática de las justicias de proximidad. Examina el paradigma socialdemócrata sobre el cual se apoyan algunas propuestas de reforma judicial en España y en Argentina y propone una excursión historiográfica por el tratamiento de las justices de proximité francesas (pre y posrevolucionarias), con el objeto de ponderar ventajas y desventajas de la utilización de esta categoría en sus propias investigaciones sobre justicias rurales de los siglos XVIII y XIX en el Río de la Plata.
The author’s purpose is to connect legal, historiographical and political aspects concerning the issue of proximity justice. This piece examines the Social Democrat paradigm on which some Argentine and Spanish legal reform proposals are based. Moreover, the article proposes a historiographical tour around French justices de proximité (before and after the revolution); the aim is to weigh the advantages and disadvantages of using this category on their own rural justice research during the eighteenth and nineteenth centuries in the River Plate area.
