En este trabajo se analiza un aspecto de la legislación de Hammurabi (1790 a.C.) que, en materia penal, podría reflejar la presencia y gravitación del elemento amorrita en la sociedad mesopotámica antigua. Se trata de la llamada Ley del Talión, una sanción que al no encontrarse presente en las legislaciones anteriores, interesa como nuevo instrumento punitivo del estado en tiempos de Hammurabi. Se observan y analizan los casos y los sujetos que aparecen como pasibles de tal sanción, y la cuestión es su finalidad y eficacia hacia el interior de una sociedad multiétnica. Este análisis revela la necesidad de una indagación más honda sobre la real aplicación de la pena talional en la sociedad que nos ocupa.
In this article, we attempt to analyze de remarkable aspect of the Laws of Hammurabi which, in the ground of penalties an punishment, probably reflects the influence of the Amorite in the Old Mesopotamian society. It concerns to the talionic principle that cannot be found in the precedent Mesopotamian Laws, and which appears as a new punitive instrument, adopted by the state during Hammurabi. We take under consideration cases and subjects envolved by the sanction in the so called “Code”, as much as the questions about it purposes, actual application, and efficiency, into this multiethnic society.
