Se ha logrado cierto consenso en considerar el concepto de “políticas públicas” como propio de las democracias liberales y, por tanto, producto de la afirmación del Estado de derecho contemporáneo. El objetivo de este artículo es poner en discusión dicho paradigma, y afirmar que esta herramienta de gobierno no fue una invención de la contemporaneidad, ni menos aun monopolio del Estado de derecho democrático, pues durante el Antiguo Régimen los gobernantes ya impulsaron políticas públicas. Para demostrar la hipótesis propuesta, es decir, que nada obsta a que se pueda utilizar el concepto de políticas públicas para analizar, describir y categorizar la acción gubernamental del Estado del Antiguo Régimen, nos centraremos en un contexto político e institucional específico –la Monarquía Hispánica– para identificar las Políticas públicas de reducción del riesgo de incendio y las políticas públicas sanitarias impulsadas por la corona y sus agentes.
Certain consensus has been achieved in considering the concept of “public policies” as typical of liberal democracies and, therefore, a product of the affirmation of the contemporary State of Law. The objective of this article is to discuss this paradigm, and to affirm that this government tool was not a contemporary invention, nor even less the monopoly of the democratic State of Law. In fact, already during the Ancient Regime the authorities promoted public policies. In order to demonstrate the hypothesis that nothing avoids that the concept of “public policies” is utilized to analyse, to describe and to categorize the governmental action of the State of Ancient Regime, the article will focus on a specific political and institutional context, the Hispanic Monarchy, to identify public policies for fire risk reduction and for public health, promoted by the Crown and its agents.
