A partir del marco conceptual de la teoría trialista del mundo jurídico, la investigación examina el fenómeno tecnológico considerando sus dimensiones sociológica, normológica y dikelógica. Sobre esa base, la obra propone la noción de “Persona Artificial” como una distribución, junto a las influencias humanas difusas y el azar, destinada a identificar ciertos sistemas artificiales que presentan grados relevantes de autonomía operativa, generatividad y alteridad en su interacción con el entorno humano. Estas propiedades permiten analizar situaciones en las que determinados sistemas algorítmicos intervienen de manera creciente en procesos de decisión, producción de información o generación de efectos jurídicamente relevantes. A partir de este enfoque, el trabajo explora las implicancias que tales configuraciones pueden tener para la comprensión de los sujetos del derecho, la atribución de responsabilidad y la estructura de los repartos jurídicos. El objetivo es aportar una herramienta conceptual que permita integrar el análisis de la inteligencia artificial dentro de una perspectiva sistemática de filosofía jurídica.This book examines the challenges that the contemporary development of Artificial Intelligence poses for general legal theory and, specifically, for the determination of legal subjects. Utilising the conceptual framework of the trialist theory of the legal world, the research scrutinises the technological phenomenon through its sociological, normological, and dikelogical dimensions. On this basis, the work proposes the notion of the "Artificial Person" as a distribution –alongside diffuse human influences and chance– aimed at identifying certain artificial systems that exhibit significant degrees of operational autonomy, generativity, and alterity in their interaction with the human environment. These properties facilitate the analysis of situations where specific algorithmic systems increasingly intervene in decision-making processes, information production, or the generation of legally relevant effects. From this perspective, the study explores the implications such configurations may have for the understanding of legal subjects, the attribution of liability, and the structure of legal distributions.
