Fernández, Silvina Laura2024-07-032024-07-032019-09-18https://hdl.handle.net/2133/27408Asumiendo el entramado complejo Derecho Penal tradicional y los „Nuevos Derechos‟ de niñas, niños y adolescentes la presente investigación analiza 27 sentencias judiciales sobre delitos contra la integridad sexual infantil de la Cámara Nacional de Apelaciones en lo Criminal y Correccional de la Ciudad Autónoma de Buenos Aires (CABA), tribunal penal de segunda instancia que integra el Poder Judicial en la Capital Federal. Los casos seleccionados tuvieron como parámetro de identificación la Ley N° 25.852/2004 que reformó el Código de Proceso Penal de la Nación (CPPN) en materia de acceso a la justicia y testimonio infantil. Contemplando la relación entre Democracia y Justicia nuestro punto de partida ha sido analizar desde una mirada sociológica y política de los tribunales las evoluciones de la Ley N° 25852 en el ordenamiento jurídico argentino sobre los cambios provocados por la normativa en base al trámite de los procesos y las sentencias judiciales. Con elementos de la epistemología de la complejidad hemos indagado sobre una necesaria reinterpretación del acceso a la justicia para niñas, niños y adolescentes víctimas y testigos ante la cultura jurídica tradicional de los jueces, pese el nuevo paradigma de escucha judicial y acceso a la justicia inaugurado por la Ley N° 25852 cuando se tratan de NNAs víctimas la norma vigente es incorporada pero aún existen resistencias notables en las prácticas judiciales.Taking into account the complex paradigm framework of traditional criminal law and the 'new rights' of girls and boys and adolescents, the present investigation analyzes 27 judicial sentences on crimes against child sexual integrity of the National Chamber of Criminal and Correctional Appeals of the Autonomous City of Buenos Aires (CABA), criminal court of second instance that integrates the Judicial Power in the Federal Capital. These cases have been selected because they were trialed based Law N ° 25.852 / 2004 that has reformed the Nation‟s Code of Criminal Procedure (CPPN) in matters of access to justice and child testimony. Establishing the relationship between democracy and justice, our starting point has been to analyze a sociological and political view of the courts the evolutions of Law N ° 25852 in the Argentine legal system on the changes caused by the regulations based on the legal procedure and the judicial sentences.
