Este artículo se presenta como una contribución al análisis de las funciones del Estado en
tanto mediador en los conflictos entre capital y trabajo, específicamente en relación a las
primeras manifestaciones de la vigencia de acuerdos colectivos. De acuerdo con este orden
de prioridades, se revisan los principales antecedentes en materia de negociación colectiva
que comenzaron a registrarse en Argentina en las tres primeras décadas del siglo XX, en la
medida en que estas primeras experiencias anticiparon el posterior desarrollo de acuerdos
colectivos de carácter estable y mucho más generalizados que contaron con la mediación
estatal, y tendieron a prevalecer desde mediados de los años treinta, profundizándose de
manera decisiva con el advenimiento del peronismo. Creemos que en estos años se irá estructurando,
aunque de manera incipiente, un sistema de relaciones y prácticas laborales en
materia de negociación colectiva, que expresará importantes elementos de continuidad respecto
de la posterior experiencia. En líneas generales, es escasa la historiografía relacionada
con la negociación colectiva en nuestro período de estudio y tiende a reflejar el problema en
forma parcial y circunscripta a ciertos sectores productivos en coyunturas particulares, no
abordando una visión de conjunto en relación a las primeras experiencias sobre acuerdos
colectivos que comienzan a registrarse con el cambio de siglo.
This article presents itself as a contribution to the analysis of the State’s role as mediator in the conflicts between capital and work, specifically in relation to the first manifestations of the validity of collective agreements. In accordance with this order of priorities, the text examines the main antecedents as regards collective negotiation which began to take place in Argentina in the first three decades of the 20th century, insofar as these early experiences suggested the subsequent development of much more widespread collective agreements of a steady nature. These were mediated by the State and tended to prevail since the mid-thirties, becoming decisively stronger with the rise of Peronism. We believe that in those years it will begin to structure, though in an incipient way, a system of labor relations and practices related to collective negotiation, which will express important elements of continuity regarding the later experience. In broad outline, there is little historiography connected with collective negotiation in the period under study and it tends to reflect the issue incompletely and restricted to certain productive sectors in particular situations, rather than approaching it as a whole in connection with the first experiences of collective agreements that begin to take place at the turn of the century
