Los derechos económicos, sociales y culturales
(DESC) están experimentando una importante
expansión respecto de su reconocimiento
como derechos operativos y judicializables.
Por el carácter de generalidad de estos derechos,
los procesos colectivos constituyen una
herramienta eficaz para llevar adelante el reclamo
judicial de su cumplimiento. Asimismo,
esto se transforma en un mecanismo de participación
ciudadana y empoderamiento, capaz
de influir en el diseño de las políticas públicas
de un Estado. Esto, además, implica reconocer
a la ciudadanía y a los jueces un nuevo papel
que antes estaba sólo reservado a los poderes ejecutivo y legislativo.
Economic, social and cultural rights are experiencing
a major expansion as regards their
recognition as operative and justiciables rights.
Due to the generality of these rights, collective
processes are an effective instrument for carrying
out the judicial claim of their compliance.
Moreover, this becomes an important tool
of citizens participation and empowerment
which is able to influence the design of public
policies. As a consequence, the citizenship and
the judges are given a new role that in the past
belonged only to the Executive and the Congress
